New York City passed a day without a single report of a person being shot, stabbed or subject to other sorts of violent crime for the first time in recent memory, police said on Wednesday.

The rare day occurred on Monday, near the end of a year when the city's murder rate is on target to hit its lowest point since 1960, according to New York Police Department chief spokesman Paul Browne.

Browne said it was "first time in memory" the city's police force had experienced such a peaceful day.

While crime is up 3 percent overall, including a 9 percent surge in grand larceny police attribute to a rash of smart phone thefts, murder is down 23 percent over last year, the NYPD said.

As for a day without violent crime, experts said they could not recall that happening in recent memory. "In a city of 8 million people, this is extremely rare," said Tom Repetto, author of 'American Police, 1949-2012.'

There have been 366 murders in the city so far this year, compared with 472 at this time last year, according to the NYPD.

By comparison, Chicago, Illinois, a city of about 2,707,000 people that has been plagued by gang violence in 2012, has registered 462 murders so far this year, according to the Chicago Police Department.

In Philadelphia, a city of about 1,536,000 people, there have been 301 murders so far this year, the exact same number as this time last year, the Philadelphia Police Department reports.

Repetto attributed New York's success to "pro-active" police department tactics, including its controversial stop and frisk policy.

While critics have charged that the dramatic increase in stops hasn't led to a similar rise in gun seizures, police officials have countered that proactive tactics have made criminals think twice about taking their guns out on the street.

We understand why we have to build a platform, the big ideas, and the small practices. Now we have our content developed (usually by writing a book), we?re ready to market.

Remember that authors are responsible for marketing. Whether you?re on a small press or a big press, if you want people to read your book, then you?ll have to sell it.?Lets be clear. I'm not a huge fan of capitalism, so "marketing" makes my skin crawl. I wish that someone else would do all of this for me. Any author would. But, I also felt called into ministry beyond the local church so I needed to get over my pride.?Unfortunately, no one is above marketing.?I did learn to reframe many steps into spiritual practices though.

So how do you do it? Here are a few suggestions. (Feel free to take these steps, personalize them, and use them for your next book proposal. The publisher is going to want a plan for how you'll market your book. These could help you with your brainstorming.)

Get a decent photo. I know, you?re not into glamor shots, but you simply have to have a good picture of your head. Don?t grab the fuzzy one someone tagged you in on Facebook. Don?t use the one you looked really good in twenty years ago. Don?t use the stock Olan Mills photo you had taken for the church directory. Get a professional photo taken. We may never look this good, but we need to try.

Develop a conference description. This is a paragraph that explains (1) what you?re going to say and (2) why it?s important.

Make posters, post cards, bookmarks and flyers. With the ease and relatively low expense of quality color copying, you can make this stuff yourself. Ask your publisher for a digital copy of your book cover, go to Zazzle, CafePress or Kinko?s, and create. I had three posters made?two to post and one I adhered to foam core so that I could use it as a display during book signings. You put them up at your church, a governing body office of your denomination, at local coffeehouses or bookstores.

Send postcards. This might get costly and digital postcards work as well, but if you can invest a bit, you can send postcards to resource centers and governing bodies. Try to send them to the people who will use them (not necessarily the head-honcho), which means you may send them to a Christian Educator rather than a pastor or to the Assistant to the Bishop rather than to the Bishop.

Use your connections. It?s always easier (and probably more effective) to send information to people who are connected to you in some way?no matter how thin the connection might be. That way, you can personalize your email or postcard. For example, I was working with campus ministry, so I sent emails to campus ministers.

There's power in the blog.?You might be trying to figure out how to the information into the hand of media giants, but don't forget your blogger friends. If you have a niche, often a good blog will be as effective as a big media splash, because you will be reaching a particular audience. Also, don't underestimate... sometimes the seminary student blogger can connect with more people than traditional media.?

Use your announcement as an opportunity for gratitude. If you hate marketing (as most authors do), make it into a spiritual exercise?an opportunity to thank God and thank others for the impact that they had on your life. For instance, if you grew up in a particular area, you can send a postcard to the committee members in the denominational body and thank them for the time and money that they put into supporting you. You can send news to your friends at your seminary, while remembering the ways they encouraged you to create. ?

Use your book signings as an opportunity for hospitality. I was a part of a writing group in D.C. Two of the members, MaryAnn McKibben Dana and Ruth Everhart, have published excellent books, and so they have thrown book parties for each other and hosted tables at Presbytery meetings for signings.

Use book signings to connect with old friends. If you went to seminary, and you have a lot of seminary buddies serving in a particular area, ask them if you can set up a book tour in their church basements, meet with clergy groups, and fill in a pulpit. Then take a week off of work and take a book tour to visit your friends. This will help you become comfortable with your material and give you feedback.

Make a video. If you?re an unknown entity in the speaking world, then people might be uncomfortable with inviting you to a conference. While your doing a church basement signings, you can have a video made to put up on YouTube. That way people can get an idea of your style and material.

Have helpful content. You may love to macram? as a spiritual practice, but that may not be what would help the most amount of people. But you could teach something about prayer, art and creativity.?If you?re a particular gender, ethnicity, age, or sexual orientation, you may want to hone your message in order say something to the whole church rather than only talking to a smaller group.?For instance, I didn?t write my first book to people under the age of forty, but I wrote it to the whole church to encourage intergenerational understanding, while focusing on younger generations.?

Ask, knock, seek. I hate doing this... but it?s important. If I knew that a particular group was having a conference, I wrote the conference organizer telling him or her that I was available, sending my course description and photo. I usually asked if I could set up a book signing, and they would invite me to teach a workshop. If you know someone who would put your name into the mix, that?s even better.?Once I did several workshops, then people began asking me to lead keynotes.

Host your own stuff. It?s a DYI sort of time. If you want to be on the radio, you can start your own podcast. If you want to speak at a conference, you can start one. It?s not always easy, but I helped to host God Complex Radio and the Unconference. And if I can do it, so can you.

There are a thousand other things that I could say about all of this, but hopefully this is enough to get you started. So go, create, and build your networks!

AIDS drug roll-out boosts South African life expectancy

JOHANNESBURG (Reuters) - South Africa has achieved a "stunning" increase in life expectancy in the last three years due to a government push to roll out antiretroviral drugs (ARVs) to people with HIV/AIDS, researchers said on Thursday.

The average South African is now likely to live to the age of 60, a study in the Lancet medical journal said, compared with just 56.5 in 2009 when President Jacob Zuma came to power with promises of a new approach to the country's HIV/AIDS burden.

Africa's biggest economy is home to 6 million HIV/AIDS sufferers but under Zuma's predecessor, Thabo Mbeki, the government was reluctant to provide the life-prolonging drugs, the study said.

Nearly 2 million people are now taking ARVs daily in what is the world's largest ARV programme. That total compares with 912,000 in 2009 and just 235,000 three years before that.

Although overall infection rates have stayed constant at around 10 percent since 2006, the study's authors said such a dramatic increase in life expectancy was unheard-of.

"There are many factors that contribute to life expectancy but the single most important one was the expansion of the ARV treatment programme," said Professor Salim Abdool Karim, director of the Centre for the AIDS Programme of Research in South Africa and a member of the Lancet South Africa team.

"That increase in life expectancy is nothing short of stunning. You don't see those kinds of increases in the real world."

Lead researcher Bongani Mayosi from the University of Cape Town singled out Health Minister Aaron Motsoaledi for praise in reversing the policies of Mbeki, whose health minister outraged activists by questioning the effectiveness of ARVs and championing the benefits of garlic and beetroot instead.

"We have no doubt that the new administration that came in 2009 was eager to make an improvement on the disastrous record of the first 15 years of the ANC government," Mayosi said.

South Africa still faced formidable challenges however, particularly in reducing huge racial disparities in housing, employment and access to health services, Mayosi said.

Just 10.3 percent of black South Africans, who make up 80 percent of the population, have medical insurance, compared with 70.9 percent for whites, who make up just 10 percent of the overall 52 million population, the study showed.

Bonds, Clemens, Sosa on Hall ballot for first time

NEW YORK (AP) ? The most polarizing Hall of Fame debate since Pete Rose will now be decided by the baseball shrine's voters: Do Barry Bonds, Roger Clemens and Sammy Sosa belong in Cooperstown despite drug allegations that tainted their huge numbers?

In a monthlong election sure to become a referendum on the Steroids Era, the Hall ballot was released Wednesday, and Bonds, Clemens and Sosa are on it for the first time.

Bonds is the all-time home run champion with 762 and won a record seven MVP awards. Clemens took home a record seven Cy Young trophies and is ninth with 354 victories. Sosa ranks eighth on the homer chart with 609.

Yet for all their HRs, RBIs and Ws, the shadow of PEDs looms large.

"You could see for years that this particular ballot was going to be controversial and divisive to an unprecedented extent," Larry Stone of The Seattle Times wrote in an email. "My hope is that some clarity begins to emerge over the Hall of Fame status of those linked to performance-enhancing drugs. But I doubt it."

More than 600 longtime members of the Baseball Writers' Association of America will vote on the 37-player ballot. Candidates require 75 percent for induction, and the results will be announced Jan. 9.

Craig Biggio, Mike Piazza and Curt Schilling also are among the 24 first-time eligibles. Jack Morris, Jeff Bagwell and Tim Raines are the top holdover candidates.

If recent history is any indication, the odds are solidly stacked against Bonds, Clemens and Sosa. Mark McGwire and Rafael Palmeiro both posted Cooperstown-caliber stats, too, but drug clouds doomed them in Hall voting.

Some who favor Bonds and Clemens claim the bulk of their accomplishments came before baseball got wrapped up in drug scandals. They add that PED use was so prevalent in the 1980s, 1990s and early 2000s that it's unfair to exclude anyone because so many who-did-and-who-didn't questions remain.

Many fans on the other side say drug cheats ? suspected or otherwise ? should never be afforded the game's highest individual honor.

Either way, this election is baseball's newest hot button, generating the most fervent Hall arguments since Rose. The discussion about Rose was moot, however ? the game's career hits leader agreed to a lifetime ban in 1989 after an investigation concluded he bet on games while managing the Cincinnati Reds, and that barred him from the BBWAA ballot.

The BBWAA election rules allow voters to pick up to 10 candidates. As for criteria, this is the only instruction: "Voting shall be based upon the player's record, playing ability, integrity, sportsmanship, character, and contributions to the team(s) on which the player played."

That leaves a lot of room for interpretation.

"Everyone has their own way of dealing with the issue, and in the absence of hard and fast rules, there will continue to be a wide diversity of opinions," Stone said.

Clemens was acquitted this summer in federal court on six counts that he lied and obstructed Congress when he denied using performance-enhancing drugs.

Bonds was found guilty in 2011 by a federal court jury on one count of obstruction of justice, ruling he gave an evasive answer in 2003 to a grand jury looking into the distribution of illegal steroids. Bonds is appealing the verdict.

McGwire is 10th on the career home run list with 583, but has never received even 24 percent in his six Hall tries. Big Mac has admitted to using steroids and human growth hormone.

Palmeiro is among only four players with 500 homers and 3,000 hits, yet has gotten a high of just 12.6 percent in his two years on the ballot. He drew a 10-day suspension in 2005 after a positive test for PEDs, and said the result was due to a vitamin vial given to him by teammate Miguel Tejada.

Biggio topped the 3,000-hit mark ? which always has been considered an automatic credential for Cooperstown ? and spent his entire career with the Houston Astros.

"Hopefully, the writers feel strongly that they liked what they saw, and we'll see what happens," Biggio said last week.

Schilling was 216-146 and won three World Series championships, including his "bloody sock" performance for the Boston Red Sox in 2004.

Arizona has now become the 17th state to refuse to create a state health insurance exchange under Obamacare. Instead, the state will be part of a federally-run exchange that will be set up by the new health care law.

States have until Dec. 14 to make a decision on the exchanges. The first photo below shows states that will create an insurance exchange and take on the costs that come with it. The second photo points out the 17 states that will not.

Judge Andrew Napolitano talked with Melissa Francis on Fox Business Network this afternoon about what this all means. Particularly, why are some states choosing to take on the added costs of running the exchange when the federal government could pick up the tab?

?Some states have governors, like (New York), who are part of the establishment that created Obamacare and are in favor of it and want to cooperate with Washington. Other states, like Arizona, are not part of that establishment and don?t want to cooperate. ? So now, instead of Arizona paying for Arizona?s health care and New Jersey paying for New Jersey?s ? all the taxpayers are paying for this,? said Napolitano, adding that the whole program will be paid for with borrowed money.

For businesses that want to offer their customers a fast, uncomplicated way to access the Internet and cloud services, the HP Passport 1912nm Internet Monitor provides a reasonably priced, albeit limited, solution. This unique 18.5-inch display is equipped with an ARM-based processor and uses a Linux OS to access web apps and play multimedia files. It's not a great performer by any means, and it's short on features, but it's cheap and easy to use.

Design and Features
The 1912nm uses an 18.5-inch TN (Twisted Nematic) panel with CCFL (Cold Cathode Fluorescent Lamp) backlighting as opposed to LED backlighting. As such, the matte black cabinet is thicker (2.6-inches) than what you'll find on most LED monitors such as the 1.3-inch thick HP 2011x . The 1,366-by-768 panel is framed by glossy black bezels measuring 0.6 inches on the top and sides and 1.2 inches on the bottom. The bottom bezel is slightly curved and holds five buttons (Menu, -, +, Mode, Power).

The 7.5-pound cabinet has four VESA wall mounting holes and comes with an oval stand that allows you to tilt the panel but offers no other adjustments. At the rear of the cabinet are an Ethernet jack, an upstream USB 2.0 port, four downstream USB 2.0 ports, and two audio ports (in, out). There's also a VGA input for connecting the 1912nm to a host PC, but digital inputs such as HDMI and DVI are missing. A fifth USB 2.0 port is conveniently mounted on the left side of the cabinet right above a card reader slot that accepts SD, MS, MMC, and xD media. The 2-watt speakers are loud and don't distort when the volume is maxed out but they are a bit too trebly.

The 1912nm is powered by a Texas Instruments dual core OMAP 4430 processor running at 1.0GHZ and is outfitted with 2GB of flash memory and 1GB of DDR2 RAM. It runs an HP customized version of Linux and uses Mozilla Firefox as its browser. Video, audio, and photo viewing apps are built in, as is an Adobe Flash player. This is a bare bones Internet device; you don't get any internal storage, it lacks Wi-Fi networking capabilities, and there are no touch screen capabilities. To get started all you have to do is plug it in, connect the keyboard, mouse, and LAN cables, turn it on and you're ready to go.

The main desktop screen contains five massive icons for the embedded apps including Music, Video, Photo, Web, and Settings. You can access files stored on media cards and USB storage devices (ie: thumb drives and portable hard drives) as well as files stored in the cloud. The settings menu is where you go to select photos for a slideshow, set the date and time, configure network settings, and enable the password option.

The monitor ships with an HP USB keyboard and an HP USB scroll mouse, but you'll have to supply your own upstream USB cable and Ethernet cable. HP covers the 1921nm with a three year parts and labor warranty that includes on-site service.

Performance
The 1912nm did a fairly good job of displaying individual swatches from the DisplayMate Color Scales test but its grayscale performance was abysmal. The five lightest shades of gray on the 64-Step Grayscale test were washed out, while over on the dark end the three darkest shades appeared black. This doesn't present much of an issue while viewing most web pages or text files,but photographs and video will suffer a loss of highlight and shadow detail. On the plus side, the screen uses a matte coating that is non-reflective and keeps glare to a minimum.

Viewing angle performance was less than optimal; there was a significant loss of luminance and lots of color shifting at around 50-degrees from dead center. However, small text from the DisplayMate Scaled Fonts test appeared well formed and crisp.

The OMAP processor performed as expected although there was an occasional 3-4 second lag between the time I clicked on a file and the time it took to open it. Web pages were a tad slow to load as well, but other than that there were no major issues.

The 1912nm averaged 22 watts of power during my testing, which isn't all that bad for a monitor that uses CCFL backlighting but still more than the Lenovo D186 (16 watts), an 18-inch display that also uses CCFL backlighting. Neither can match the energy efficiency of LED backlit displays such as the Lenovo LS2421P Wide , which has much larger 24-inch panel but averaged only 16 watts of power.

The HP Passport 1912nm is a good fit for libraries, hotel lobbies, hospitality centers, and any other business that needs to supply affordable web access to its customers. It's easy to set up and easy to use, and it performs as advertised. That said, HP should consider replacing the under-achieving TN panel with a low-cost e-IPS panel that would provide much better color, grayscale, and viewing angle performance. A more powerful processor and wireless networking would be welcome too.

To recognize a gifted child, several other indicators are usually present.? Does your child ask more in-depth questions?? When other children are asking to have a snack, does your child want to know how it is made?? Does your child seem to see and understand the patterns in things, whether it is music, math, or language?? Does he or she learn without being taught and demonstrate new knowledge to you on a regular basis?? Does he or she seem unusually starved for information or obsessive about learning everything about a specific topic?

When you have a gifted child, it is a blessing and a challenge.? All children need love and attention to succeed, but often, gifted children require more attention and intervention than those who have learning disabilities, because while they might be capable of reading chapter books and doing algebra, they also concern themselves with the world on a grander scale.? Your five-year old gifted child may worry about death or world peace or the environment.

Gifted children often have difficulties fitting in with their peers at school.? Extra time may have to be taken to help them socialize and adjust.? In addition, a child can be gifted in one area and struggle in another, or be gifted academically but struggle with motor and spatial skills.? It is important to make no assumptions about your child but to treat him or her as an individual.? Address your child?s needs without assuming that because of the giftedness, he or she can figure things out on their own.? If anything, these children need your support and need to be encouraged to still be kids.

Your gifted child may be obsessed about learning, but don?t forget to encourage physical development and social development as well.? Encourage your child to play and be a kid.? Even the best young minds need to climb, skip, hop, jump rope, laugh, and play.

The most important thing to remember is that all of our kids are gifts regardless of their academic ability, and each child deserves to be treated as an individual.

Hit by Drought, Mississippi River May Face More Challenges

Barges on the Mississippi River in St. Louis on Friday. A plan approved by Congress for maintaining irrigation systems is likely to affect shipping in the region.

The drought of 2012 has already caused restrictions on barge traffic up and down the Mississippi River. But things are about to get a lot worse.

As part of an annual process, the Army Corps of Engineers has begun reducing the amount of water flowing from the upper Missouri River into the Mississippi, all but ensuring that the economically vital river traffic will be squeezed even further. If water levels fall low enough, the transport of $7 billion in agricultural products, chemicals, coal and petroleum products in December and January alone could be stalled altogether.

?Without the river, we?re in a world of hurt,? said Kathy Mathers, a spokeswoman for the Fertilizer Institute. About half of the spring fertilizer that the industry sells to Midwestern farmers travels upriver, she said, and options to get the fertilizer to the fields by other means are few. ?We know the rail cars aren?t there,? she said. The corps reduces water flow from the upper Missouri every year as part of its master plan for maintaining irrigation systems and meeting other water needs of the region, which stretches from Montana to St. Louis. This year the process began on Nov. 11, as the corps began reducing water flows from the Gavins Point Dam near Yankton, S.D. The flow has already been reduced from 37,500 cubic feet per second to 26,500, and will reach 12,000 by Dec. 11.

The plan, approved by Congress, has the power of law. ?We do not have the legal authority to operate the Missouri River solely for the benefits of the Mississippi River,? said Monique Farmer, a spokeswoman for the corps.

Michael Toohey, the chief executive of the Waterways Council, a group that lobbies on behalf of inland carriers, operators and ports, said that argument rings hollow. ?The corps could do it,? he said. ?They have the authority to do it. They don?t have the will to do it.?

Water levels on the Mississippi near St. Louis are approaching record lows ? and whether or not the Coast Guard actually closes down navigation, the effect on shipping will be the same, said Martin Hettel, a senior manager at the American Electric Power River Operations. ?Economics will shut the river down,? he said.

Carriers have so far responded to low water by loading barges with less cargo so that they will ride higher in the water, reducing their own efficiency. But as the river level continues to drop, Mr. Hettel said, ?you can load the barges lighter, but if you don?t have a light-draft towboat you can?t move them.?

The effects, he predicted, will not be felt by businesses alone. ?When the cost of shipping raw materials goes up, the consumer ends up paying for that,? he said.

Maj. Gen. John W. Peabody, the commander of the Mississippi Valley division of the corps, said at a Nov. 16 news conference in St. Louis that the corps has been actively dredging the river and has released smaller amounts of water from other reservoirs, but has to think about long-term response to the drought. ?Some people compare this to a battle,? he said, but ?I compare it to a campaign ? this is not something we can solve in a few days, or a few weeks, or even if a few months if we have a persistent enough drought.? He added, ?We?re going to have to husband our resources for when the situation gets truly dire ? and in my personal estimate, we are not there yet.?

The reservoirs along the upper Missouri are already 20 percent below the levels that normally get the region through the coming year?s drought season and that allow commercial navigation on the Missouri between April and November, said Charles Shadie, chief of the watershed division for the Mississippi Valley division; ?they are already concerned that they may not have a full navigation season on the Missouri next year.?

The corps is also taking on a blasting project, which will allow traffic to proceed despite the low water levels. The project will eliminate rock formations known as pinnacles in Southern Illinois at Thebes and Grand Tower, but the work is not projected to begin until February. Fifteen senators and 62 House members have asked for the government to speed up the process.

Senator Tom Harkin, Democrat of Iowa, who was the principal author of the Senate letter, said that disrupting traffic along the Mississippi, ?has the potential to impact the entire economy along the river ? everything from increasing the cost to move goods to potential job losses.?

He called for President Obama to issue an emergency declaration to increase water flow from the Missouri and to get rid of the pinnacles quickly.

?The only person that?s going to be able help us is the person who lives at 1600 Pennsylvania Avenue,? Mr. Hettel said. ?Unless we get rain.?

At the St. Louis news conference, General Peabody jokingly recommended an appeal to an even higher authority. ?If anybody knows how to create rain upriver of where we are today, I encourage you to leverage the impact that you have,? he said.

Halle Berry is reportedly off to court this week in an effort to extend a temporary restraining order against her ex Gabriel Aubry, following the Thanksgiving punch-up with the actress? current partner, actor Olivier Martinez.

If granted, Aubry, 36, could lose rights to see his four-year-old daughter, Nahla, for an indefinite amount of time, according to family law experts.


?A restraining order is a game-changer,? attorney Diana Mercer told Celebuzz. ?If this restraining order holds up, the legal presumption is Gabriel can?t have joint custody of any kind.?

Mercer, author of Making Divorce Work: 8 Essential Keys for Resolving Conflict and Rebuilding Your Life, said the court would decide the fate of the Canadian-born father based on whether ?your judgment is poor? and thus you can?t have legal or physical custody of the child.?

Berry?s lawyers have previously argued that Aubry has an uncontrollable temper.

The pair dated for four years before their split in 2010 and since have become embroiled in a bitter court battle over custody of Nahla.

Earlier this month, a judge denied the actress? request to move to France with Nahla and Martinez ? a decision widely considered a court victory for Aubry. He argued the move to France would have been punitive and was designed to stop him from having contact with his daughter.

?The biggest thing is going to be that restraining order hearing,? added Mercer.

She said Berry ?can go back in (to court) and ask for modification of the moving order,? she said. ?It would have been better if Olivier had stayed out of it. But thanks to O.J. Simpson, the police err on the side of caution.?

But Darren Kavinoky, a Los Angeles based criminal attorney, said the Cloud Atlas star shouldn?t expect the judge?s decision to be reversed completely.

?Just because he behaves badly, she would not be able to relocate to France. In other words, I wouldn?t go renew my passport now,? said Kavinoky.

But Kavinoky said Aubry?s ability to have custody of Nahla is in question.

?This whole incident gives rise to a renewed discussion? in terms of him being able to parent appropriately,? he said.

?I would expect that if she [Berry] is looking for renewed leverage, now she has it. This incident opens the doors to raise the issue about his capability of managing his own behavior.?

If the court believes that as a result of his inability to control his own impulses that his abilities to parent are compromised, then it?s possible that his visitations would be limited,? he said, ?and it?s possible that he could only be with his kid under monitored supervision.

?What the court is going to be struggling with is asking themselves if his ability to control himself spills over to his parenting ? or just limited to just the new man in his daughter?s life.

?Even if it?s found that in this instance he had too much testosterone for his own good, if I?m on his side, I?m going to argue ?I may not play well with other grown-ups, but I can still be an effective, loving parent.?

?With this issue,? Kavinoky added, ?ultimately the court has a lot of discretion to do what?s in the best interest of the child.?

U.S. investigating use of force by Albuquerque police

(Reuters) - The Justice Department said on Tuesday it launched a civil rights probe into whether the police department in Albuquerque, New Mexico, has shown a pattern of using excessive force on civilians.

The investigation - which is civil, not criminal - is one of 14 active police reform investigations across the country, according to the Justice Department.

There have been 25 shootings involving Albuquerque police officers since 2010, 17 of which were fatal, according to KOB, a news station in the city.

"Our investigation into APD's (Albuquerque Police Department's) use of force practices will be thorough, fair and independent," Assistant U.S. Attorney General Thomas Perez said in remarks prepared for a press conference. "We will peel the onion to its core, and leave no stone unturned."

If federal officials find systemic violations, they will seek to reach an agreement with the city to fix the problems, but if an agreement cannot be reached, the attorney general could bring litigation, Perez and U.S. Attorney Kenneth Gonzales told Albuquerque Mayor Richard Berry in a letter on Tuesday.

The investigations into police departments across the country stem from a 1994 law that gives the Justice Department authority to fight violations of U.S. laws or the Constitution by police departments.

In July, Attorney General Eric Holder placed the New Orleans Police Department under the scrutiny of a federal monitor, and days later Seattle officials reached an agreement with the Justice Department to refine the use of force by police officers.

Last year, the Justice Department said it was conducting a preliminary review of the Albuquerque Police Department.

Berry, who has been mayor since December 2009, said in a statement that his administration will cooperate with the investigation and that there have already been dozens of reforms to training, policies and procedures.

"As the investigation unfolds in the coming months, we will continue to address issues if and when they arise," Berry said.

(AP) ? Three women AIDS activists saying they wanted to highlight the "naked truth" about potential spending cuts in HIV programs were arrested Tuesday after taking their clothes off in the lobby of House Speaker John Boehner's office.

The trio had the words "AIDS cuts kill" painted on their bodies and had linked arms with four men who also disrobed as part of the protest. The nude protesters, along with dozens of other clothed demonstrators chanted slogans, including: "People with AIDS are under attack. What do we do? Fight back."

The three women were arrested by Capitol Police as they mingled with other protesters in the hall outside Boehner's district office after putting their clothes back on. The naked male protesters appeared to have left.

"People with AIDS are sick and tired of being pushed over the cliff," said Jennifer Flynn, 40, of New York City, who was among those arrested. "We need to make sure they stop going after people with AIDS."

Michael Tikili, 26, of New York City, said he is HIV-positive and depends on Medicaid for treatment.

"Just the idea of these programs being cut is horrible," Tikili said.

The three nude female protesters were charged with lewd and indecent acts under the District of Columbia's disorderly conduct law, a Capitol Police spokesman said.

The protest occurred as congressional leaders and President Barack Obama seek a deal to avert automatic spending cuts and tax increases in January. A coalition of AIDS activist groups gathering in Washington for Saturday's World AIDS Day organized the protest.

Boston mayor transferred from hospital after one-month mark

BOSTON (Reuters) - Boston's longest-serving mayor, Thomas Menino, was transferred on Monday from the hospital where he has been receiving treatment for a virus and back pain over the past month to another facility where he will continue his recovery.

The prolonged illness, and a new diagnosis of diabetes, come a few months before the 69-year-old Democrat must decide whether to seek a sixth term in the office he has held since 1993. He is up for re-election in November 2013.

Officials gave no immediate timetable for the 69-year-old Democrat's eventual release from Spaulding Rehabilitation hospital, where he will undergo physical therapy and continue to run the city from his hospital room.

"Now it's a matter of getting him stronger so that he can do all the things he typically does at this time of year," said Dot Joyce, Menino's spokeswoman. "He's able to engage fully. He meets with staff at least once a week and also takes calls as necessary, but right now he is focused on his care."

A prolonged hospitalization could increase the odds of a challenger seeking to unseat the incumbent, though he remains popular with Boston voters after almost two decades in office, observers said.

"In Boston, usually once you're in as mayor, most mayors tend to last a long time," said John Berg, a professor of government at Suffolk University in Boston. Menino's predecessor, Raymond Flynn, stepped down when President Bill Clinton named him ambassador to the Vatican.

Berg noted that Menino's campaign organization played a major role in supporting Senator-elect Elizabeth Warren's successful campaign to unseat Republican Sen. Scott Brown, a clear show of Menino's continued power even while he was in the hospital.

Joyce said it was "too soon" to comment on Menino's plans for the next election.

Menino was admitted to Brigham and Women's Hospital in Boston on October 26, after cutting short a vacation to Italy due to a virus. During his time in the hospital doctors also discovered and treated an infection in his back and diagnosed him with Type II diabetes.

On the national stage, Menino has stood out as an advocate for gun control and gay marriage, issues on which he has often worked alongside New York City Mayor Michael Bloomberg. In July, he publicly urged fast food chain Chick-fil-A to stay out of Boston due to its president's "prejudiced statements" on same-sex marriage.

Much as the title says, I am looking for a 1:1 partner for a FMA roleplay. I would like the plot to develop some sort of romance eventually, and I'm fine with having each person have multiple characters. Here are some of the parings I'm interested in, and I'm open to discussing other parings.

It's the turn of the 19th century in London. Edward is a homeless young man who, after escaping from an abusive household as a child, has vague memories of a younger brother. After escaping, Ed is raised by Roy Mustang for some time before Roy mysteriously vanishes, and Ed is on the streets. After years of this, Ed has survived with different odd jobs, but the cold of another London winter is about to set in...

Anyway, this plot baby provides for a flexible plot in a historic setting, it can bring in all of the characters mentioned above, and can be adjusted if you are interested in playing as Roy. I will send you my original first post for that roleplay if you are interested, or if you are interested in something else please shoot me a PM.

Budget battle weighs on shopping season

The impasse in Congress over the ?fiscal cliff? could be the Grinch that steals Christmas if it isn?t resolved soon.

A record 247 million shoppers visited stores and websites over the four-day Black Friday weekend, up 9 percent from last year, according to the National Retail Federation. They spent an average $423 this year, up 6 percent from last year, for a total of $59 billion.

?I think there's a long way to go,? said retail industry analyst Dana Telsey. ?This season is going to be a battle almost every single day as you keep getting through to those ten days before (December) 25th. I think we go into a lull period now before you get the big sales coming again.?

Even without the uncertainty over a $500 million wave of tax hikes and spending cuts set to hit paychecks Jan. 1, retailers face some major challenges this holiday season.

With unemployment stuck at nearly at 8 percent, millions of households are without paychecks. Still reeling from last month?s Superstorm Sandy, millions of hard-hit households have had to dip into savings to clean up and rebuild. (Based on insurance data from previous storms, as much as half of the estimated $50 billion in property losses may have been uninsured.) Spending on lost household furnishings and damaged homes will divert funds that would otherwise have gone to holiday shopping.

Spending may also fade this holiday season because, continuing a decade-long trend, retailers kicked it off ?even earlier this year. Some consumers have already spent all or part of the money they budgeted for the holidays.

With so much economic uncertainty this year ?retailers started extending their promotional period,? said American Express vice chairman Ed Gilligan. ?Our research says that some people have been holiday shopping since Halloween or even earlier.?

Consumers who haven?t finished ? or even started ? their holiday shopping face continued uncertainty until Congress and the White House reach a budget deal. One of the biggest single hits to spending would come from the expiration of jobless benefits which, unless renewed, would remove $26 billion from consumer spending next year, according to the non-partisan?Congressional Budget Office.

Since the recession hit in 2007, Congress has battled multiple times over the extension of four separate? tiers? of extended benefits. As a result, most beneficiaries are keenly aware of just how vulnerable they are to a last-minute cutoff of those extended tiers.?

All those people facing expiration are going to keep their wallets closed, even if a last-minute deal is reached before year-end.

On Monday, a White House report estimated that letting taxes rise on middle-class families would take a? $200 billion bite out of consumer spending in 2013. That 1.7 percentage point cut in spending would knock 1.4 percentage points off GDP growth, according to the White House's National Economic Council and Council of Economic Advisers.

The retail industry, which has accounted for nine percent of employment growth since the U.S. recession ended in June 2009, would be among the hardest hit, the report said.

The CBO has estimated that, unless modified or postponed, the budget law set to take effect in January will push the U.S. economy back into recession and send the unemployment rate to 9.1 percent ? up from the current 7.9 percent. The budget package would send the nation?s gross domestic product, which grew at a 2 percent annual rate in the third quarter, into reverse, shrinking at a 0.5 percent rate, according to the CBO analysis.

Much of the contraction would come from a sharp slowdown in consumer spending, according to Monday?s analysis by the White House of the impact on middle class consumers.

The report was the latest volley by President Barack Obama in his ongoing political battle to strike a deal with Republicans that would extend tax cuts for families making less than $250,000 a year and raise taxes on people making more.

Shortly after his re-election, Obama called on Congress to extend tax cuts for 98 percent of American families even before wider deal is reached. The White House also wants lawmakers to fix the alternative minimum tax, set up decades ago to remove tax breaks for high-income households. Because it was not indexed for inflation, is has to be fixed every year to avoid snaring in millions of less affluent taxpayers.

Middle class households ? along with all wage earners - will also lose about $68 a week in spending money if the two percent payroll tax holiday is allowed to expire.

Greg's Family's New Cat Will Come Home Tomorrow

This is just a random picture of a kitten not ?Thunder.?

The search for a new cat has a conclusion. I was working so I couldn?t go with the family to pick out the kitten. We found one at The Greater Androscoggin Human Society. A little gray kitten who my sons are calling ?Thunder.? The only hurdle is we couldn?t take him home today, but it?s for good reason. Tomorrow morning he?s being fixed and getting his shots. We?ll have a new family member sometime after that. I will post pictures after I get home tomorrow night. He was born at the shelter and was waiting for adoption. Other than that I don?t have much more information at this time. The bottom line is, we have a kitten!

Why a national online sales tax may not pass | Constitution Daily

If you start seeing new taxes on your online purchases, it?s not a mistake. States are asking some web sellers to collect taxes, despite a Supreme Court ruling. But the issue is far from settled in Congress and the courts.

The giant online retailer Amazon is in the process of charging Internet shoppers in some states for sales and use taxes for products purchased online, based on where they live.

Amazon is voluntarily charging the taxes as part of an agreement with some state governments in an effort to avert lengthy litigation. Amazon also maintains distribution facilities in some states.

Other online sellers, like eBay and Overstock, are strongly opposed to current efforts to implement online sales and use taxes. Facebook, Yahoo! and AOL are also part of an industry group called NetChoice, which opposes such measures as restrictive to small business.

In the past, online businesses cited a 1992 Supreme Court ruling, Quill Corp. v. Heitkamp, as proof that websites and online retailers don?t have to charge?and collect?sales taxes in states where they don?t have a physical business.

Quill was an out-of-state main-order house that sold products without having a store or sales staff in North Dakota.

The Supreme Court found that states had a right under the Due Process Clause of the Constitution to collect sales taxes, but the burden placed on out-of-state businesses violated the Commerce Clause.

?The State?s enforcement of the use tax against Quill places an unconstitutional burden on interstate commerce,? said Justice John Paul Stevens.

The court then placed the ball in the court of Congress, saying that the ?underlying issue here is one that Congress may be better qualified to resolve, and one that it has the ultimate power to resolve.?

Two decades later, bipartisan support grew within Congress this summer of the national enforcement of sales and use taxes in the 45 states that assessed them.

The requirement of any national online sales tax measure would be to streamline the process used by any company to collect sales and use taxes across 45 states, so it isn?t a burden to conducting business.

In a tough economic climate, states want the tax revenue from online sales. Some states, like Pennsylvania, are requiring that tax payers estimate what they buy online each year as part of an annual use tax.

The National Conference of State Legislatures estimates that online sales taxes, if enforced nationally, could bring in $23 billion a year for such states.

One problem stalling congressional action is deciding on how such a bill would affect small businesses.

The primary piece of legislation is the Marketplace Fairness Act, proposed by three senators: Richard Durbin (D-Illinois), Mike Enzi (R-Wyoming) and Lamar Alexander (R-Tennessee). It would exempt a business making less than $500,000 a year from collecting sales and use taxes.

Steve DelBianco, the executive director of NetChoice (the industry group opposed to the current efforts), told the Senate in August that a proposed streamlined tax-collection process would add to the costs and complexity of running a small business.

?Congress should not sweep Quill aside without first requiring that states truly simplify their tax systems in an accountable way, while providing adequately protection for America?s small businesses,? he said.

Supporters of efforts such as the Streamlined Sales and Use Tax Agreement, which has been adopted by 24 states, say it?s an issue of fairness, in addition to states losing out on tax revenue.

The key issue is how effectively a computerized system can be established to collect taxes not only from 45 states and the District of Columbia, but also additional local sales taxes, and get the revenue in the hands of the correct people, without imposing a huge cost on small business.

The Marketplace Fairness Act will likely face challenges in Congress before it could become a law, and then face a whole new set of legal challenges if it is passed.

A top lobbyist told The Hill that the three top supporters of the Marketplace Fairness Act will try to get the law passed before January.

David French, from the National Retail Federation, said the task will be much tougher in the House than the Senate.

Senator Jim DeMint (R-South Carolina), a powerful senator aligned with the tea party, is a vocal, public opponent of the Marketplace Fairness Act.

?If states want more taxes, they can raise taxes on their residents, but it?s antithetical to our federalist system to let states raise taxes on out-of-state residents,? DeMint said in editorial in U.S. News & World Report in August.

?Call this legislation what it is: A nationally-mandated Internet tax on small business. It?s anything but fair,? he said.

The Hill says DeMint had put the bill on his lame-duck watch list for December.

Another person on record as opposing the Marketplace Fairness Act, although not as vocally as DeMint, is Grover Norquist from the Americans for Tax Reform.

The bill?s supporters have presented the law as a states? rights issue, which may help it get some traction, and as an effort to collect taxes and close tax loopholes. In fact, the introduction of the bill calls it an effort ?to restore States? sovereign rights to enforce State and local sales and use tax laws, and for other purposes.?

But passing the bill will be tricky in a potentially super-charged political climate after a general election and during fiscal cliff negotiations.

And the appearance of a tax hike on small businesses and consumers, even if it is presented as closing a tax loophole, will get a lot of attention in the online community.
